All persons accessing and/or using the website www.HapsMap.com (the "Site"; or the "HapsMap Site") agree that their access and use of the Site shall be subject to all of the following conditions (the “Terms of Use"). All non-logged in or non-registered visitors ("Visitors") and logged in users ("Users") indicate by their access and use of the Site that they have read, understand and fully agree to the Terms of Use. As such, we request that all Visitors and Users of the Site carefully read all the Terms of Use. The material herein shall cover the legal rights, remedies and obligations of Visitors and Users of the Site, including numerous applicable limitations and exclusions. The Site is owned and operated by HapsMap LLC (“HapsMap”). All trademarks and trade dress found on the HapsMap Site (including linked pages owned and operated by HapsMap) may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without HapsMap's prior written permission. If you have a HapsMap Site account, we may attempt to notify you when major changes are made to the Site’s Terms of Use or the HapsMap Site. However, changes may also be made at any time without direct notification. Visitors and Users of the Site are responsible for keeping informed of the Terms of Use and should periodically review the most up-to-date version available on this page (http://HapsMap.com/static/terms).
The HapsMap Site and Service:
The HapsMap Site is a free-to-use platform that allows users to share happenings (past, present or future) by geographic location on the map on the Site’s Main page.The HapsMap Service (the "Service") allows Users to share happenings on this map with other Users and Visitors of the Site and gain further information by discussing happenings with other Users of the Site. The Site's Home page map displays happenings by the day they have been posted for and will automatically default to display the posts for the current day. As the HapsMap Site is a public website that is based around User submitted content, we cannot guarantee the nature of any of the material that is posted to the Site. All Users and Visitors of the Site imply, in accessing the Site, that they will not use the Site for abusive purposes. Users and Visitors of the Site further must accept in full the conditions outlined in the Terms of Use and the Privacy Policy in order to use the HapsMap Site and Service. HapsMap reserves the right to remove or modify any posted information, as is determined appropriate by HapsMap, without contacting the Site User who posted the content originally.
Once again, if you are unwilling to be bound by the HapsMap Site Terms of Use and/or Privacy Policy, please do not access or use the Site and Service.
Eligibility for use of the HapsMap Site and Service:
You must be 18 years old or over (or the legal age to form a binding contract in your jurisdiction if that age is greater than 18 years of age) to register with the HapsMap Site and use the HapsMap Site and Service. If you are under the age of 18 or the applicable legal age in your jurisdiction, you may only use the HapsMap Site in conjunction with, and under the direct supervision of your parent or guardian who has agreed to the Site’s Terms of Use. If you do not qualify, do not access or use the HapsMap Site. Membership in the HapsMap Site is void where prohibited by applicable law, and the right to access the HapsMap Site does not apply in such jurisdictions. You must be 13 or older to use the site, in compliance with the Children's Online Privacy Protection Act (COPPA). By using the HapsMap Site, you proclaim and guarantee that you have the right, authority, and capacity to enter into the Site’s Terms of Use and to abide by all of the conditions set forth herein. The HapsMap Site is administered in the United States and intended for use within the Unites States; any use outside of the United States is at the user's own risk. All users of the Site are responsible for compliance with any local laws applicable to their use of the Service or the Site.
HapsMap Site registration and account security:
Use and access to some features of the HapsMap Site’s may be restricted to individuals who have registered with the HapsMap Site and created a Site account and password. One's Display Name is the name that will be associated with all of one's public activity on the Site – it is the name that will be visible to other Users and Visitors of the Site. Registered Users of the Site will log in with an email address that they own and use and a password of their choosing. The HapsMap Site will keep registered Users’ email addresses private, using them only to verify registrants and send Site related information to Users. Should you choose to register with the Site, you must provide HapsMap accurate, complete, and up to date registration information. Failure to meet any or all of these stipulations will constitute a breach of the Site’s Terms of Use which may result in immediate termination of your account. In registering with the HapsMap Site, you may not: (a) enter, select or use a false name or an email address owned or controlled by another person with the intent to impersonate that person, or, (b) use as a Display Name a name subject to any rights of a person other than yourself without appropriate authorization. HapsMap reserves the right to refuse registration of, or to terminate, at its sole discretion, any User's account at any time. All registered Users of the Site shall be exclusively responsible for maintaining the confidentiality of their own passwords and are responsible for all activities that occur under their own accounts and passwords. Accounts are provided to registrants exclusively for the registrant’s own access to the HapsMap Site and Service and shall be for personal use only. You agree to immediately notify HapsMap of any unauthorized use of your account or password. You agree to always Log Out from your account every time you are finished using the HapsMap Site and Service by clicking the Log Out button.
General use of the HapsMap Site:
You are prohibited from copying or distributing, in any manner, any aspect of the HapsMap Site and/or the HapsMap Service for any purpose without HapsMap’s express written permission. You understand that by using the HapsMap Site and Service you may be exposed to content that is offensive, indecent or objectionable. HapsMap is not responsible for any of the content posted onto the Site by third parties or Users of the Site – this includes any posted happenings, comments or images. HapsMap does not guarantee the accuracy, character or quality of any content that is posted to the Site. Additionally, the Site may contain links to outside, third party websites that are not owned or affiliated with the HapsMap Site. HapsMap cannot censor or edit the content found on such third party websites linked through the HapsMap Site. HapsMap will not be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind sustained as a result of your use of any of the Site's content or Service. You are responsible for complying with all laws applicable to the content you submit to the HapsMap Site. You agree that you shall bear all risks associated with the use of the HapsMap Site and Service, including any reliance on the accuracy, character or quality of any content found on the Site.
General use rights restrictions:
A. You are prohibited from distributing, in any manner, any part of the Site, including but not limited to User submitted content, without HapsMap’s prior written authorization.
B. You are prohibited from using any device, software or practice that interferes with the proper working of the HapsMap Site and/or Service; likewise, you are prohibited from taking any action that creates, in HapsMap’s sole discretion, an unreasonable or disproportionately large burden on HapsMap’s technology infrastructure; likewise, you are prohibited from using any robot, search/retrieval application, or other external automated device, to retrieve or index any portion of the HapsMap Site.
C. You are prohibited from collecting any information about Users of the Site (including Display Names and/or email addresses) for any purpose other than to solicit and share Site appropriate information with other HapsMap Site Users and Visitors; likewise you are prohibited from copying or storing any User submitted content available on the HapsMap Site for other purpose than your own personal use; likewise you are prohibited from collecting or storing personal data about other Users relating to any of the prohibited activities found in the Site’s Terms of Use.
D. You are prohibited from creating Site accounts by automated means or under false or fraudulent pretenses; likewise you are prohibited from reformatting or framing any portion of the web pages that are part of the HapsMap Site and/or Service.
E. You are prohibited from creating or transmitting unwanted electronic communications such as "spam" to users of the HapsMap Site; likewise, you are prohibited from transmitting any viruses, worms, defects, Trojan horses or other items of a destructive nature.
F. You are prohibited from using the Site for any commercial use without HapsMap’s prior written authorization. Prohibited commercial uses include but are not limited to any of the following actions:
Content that you may post on the HapsMap Site:
As a HapsMap Site User, you are exclusively responsible for all content and material that is posted under your account. This includes any content or material that is posted or otherwise published under your account on the HapsMap Site or any information that is transmitted to other Users and/or Visitors of the Site. As a HapsMap User, you will not purposely post or otherwise transmit false or misleading information on the Site. Under no circumstances may you post, distribute, or reproduce in any way whatsoever any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights.
